You are not legally required to transfer the software when donating an old
machine. Microsoft has changed the text on their web site though a section
of it still claims legal requirement (which is disputed by their new first
paragraph).

Also, I wonder if Microsoft will recall the brochures they distributed to
thousands of school districts with that same lie?

You can doate any computer bare of OS or with one you legally installed
yourself. For the OEM license, check the EULA carefully, it appears to be
autorized for use on One CPU at a time (not to worry if you have
Multiprocessors, 95, 98, & ME will use only one).
